The Electronic Invoice will be mandatory in Spain

The Council of Ministers has approved a bill that will affect all companies and freelancers in the country. It is the Law of Creation and Growth, which will come into force in the next months, and whose main objective is to boost production investment, innovation and modernization of companies.

One of the most outstanding aspects of the Law, also known as Create and Grow, is that it promotes the use of the electronic invoice in operations between companies and freelancers as a business digitalization measure as well as a mechanism to fight against default payment in commercial operations.

In regards to the use of the Electronic Invoice, the Law includes the following key aspects:
  • All companies and freelancers should issue and send electronic invoices in their commercial relations with other companies and freelancers.
  • Electronic invoices should comply with provisions of invoicing regulations.
  • Companies and freelancers should facilitate access to computer programs necessary so recipients can manage their invoices free of charge during the general statutes of limitations period of 4 years.
  • It also contemplates a specific penalty regime for not offering customers the possibility of receiving electronic invoices or not allowing them to be downloaded, with a financial penalty of up to 10,000 euros.
